I,                                                              (the CLIENT(s) agree to pay a (non-refundable) deposit of $300.00 per fountain, as a faithful retainer for said stated services performed by CHOCOLAT ELEGANT FONDUE, INC. This deposit will be applied toward the final balance of my contract at the time of this Agreement. In addition, a Contingency Deposit of $100.00* is due at booking, as described below. Immediate payment reserves and secures my event date. To confirm this agreement, I will complete, sign, and return this contract with the deposit within five (5) days. The remaining balance is due two (2) weeks prior to my event.

NOTE: To make your deposit payment by credit card call 1.708.562.4600.

When paying by check you have five (5) days to mail in your deposit to secure the event date. In the interim, should another client desire the same date we will contact you by for telephone or e-mail to give you the right of refusal. Remember, your date is held tentatively until we receive your deposit.

Upon receipt of your agreement and deposit payment, CHOCOLAT ELEGANT FONDUE, INC. agrees to reserve your date at time of signing of this agreement. This date/time slot will be set aside for the rental of fountain, and will be held until your balance is received. Receipt and Letter of Confirmation will be mailed, faxed or e-mailed to you.

Partial balance payment arrangements are available upon request.

All unpaid balances must be received two weeks’ prior to the event or your deposit will be forfeited. You will receive an e-mail and/or telephone call reminder.

General Specifications:

As described, the Chocolat Fountain is not recommended for outdoor use due to wind conditions and pest issues. (Sorry―No Chocolat showers allowed!)

§    The fee for a four-hour timeframe rental of our commercial-grade fountain as set forth in your selected package includes two (2) hours fountain running time, set-up, break-down and clean-up.

§    NOTE: A Contingency Deposit* of $100.00 (when applicable) is required. Based on our experience, there are instances when your venue or party host departs from their scheduled serving time, requiring Chocolat to adjust its' running time accordingly, subsequently resulting in additional staff compensation. This contingency deposit will be credited via on-file credit card or a business check issued if incidental adjustments need not be made.

§    Premiere Belgian Couverture Chocolate for up to designated number of guests, and bamboo skewers. Additional Chocolate available at $60/10 lbs.

§    NO WORRIES!! Service™ - CHOCOLAT ELEGANT FONDUE, INC. provides you with your own professional server for the duration of the event. Our staff will set-up a beautiful display, monitor the Chocolat, and even serve your guests if you so desire. When the event is over, our staff cleans up and we're on our way! Client will provide take-home containers if they desire left-over dipping items drizzled with Chocolat.

§    Client-Initiated Running Time Add-On: Rental and service time can be extended at $100.00/hour. Overtime shall be defined as time that CHOCOLAT ELEGANT FONDUE, INC. continues to provide services for Client past agreed time at above stated rate. (whether due to delay or upon request). This will not be charged without verbal approval from Client. The parties agree that CHOCOLAT ELEGANT FONDUE, INC. is not obligated to work past the original contract time, but will make every effort to do so and apply contingency deposit as necessary.

§    Plates and Napkins: Customer may opt to provide own tableware, request provision by venue (when applicable) or Chocolat Elegant Fondue may provide at discussed rate.

§    Direct Service Area (DSA):  Event venue is located within 30 miles of direct service area.

§    Range Service Area (RSA): Events located outside of direct service area. RSA=$30/30 mile range.

§    Client-provided dipping items: Set-up and/or preparation by our staff required at $50/hour. Additional prep time will be required prior to event start time. Pre-arrangements must be made for dipping item delivery to venue. Please discuss this with your Chocolat Elegant representative.

§    Chocolat-provided dipping items: Includes set-up and prep in quoted per person rate.

§  Early Set-Up Option: For clients who desire to have their fountain table set-up prior to event start time this option is available. Fee is based on venue, access, location, and CEF Schedule. Please discuss this with your CEF Representative.

 

Contract Requirements:

§    Client-initiated add-ons will be payable prior to event start time. If Client is unavailable a pre-selected representative should be designated to handle these details.

§    CHOCOLAT ELEGANT FONDUE, INC. requires that a serving area be available and prepared at least 1-1/2 hours prior to serving time, and 45-60 minutes following service.

§    The client is responsible for providing two (2) sturdy, leveled square or rectangle skirted table (no less than 120 inches) with table linens, capable of holding at least 150 pounds each. (Round tables are not recommended for our application).  If only one table is provided, CEF will opt to only set-up half their normal display.

§    CHOCOLAT ELEGANT FONDUE, INC. requires at least one grounded outlet 120-volt safety-standard UL rated circuit supplying at least 15 amps of service. For safety-purposes, the table must be located within close proximity to the power source.
§    Client accepts full responsibility and is liable for any damages injuries or delays that may occur as a result of failure to comply with these provisions, and or guest non-adherence to fountain use recommendations.



Cancellation: No cancellations, except in writing by either party (Client or CHOCOLAT ELEGANT FONDUE, INC.). Deposit will be forfeited if cancellation is initiated by Client. Liability of CHOCOLAT ELEGANT FONDUE, INC. to perform said services is subject to proven detention due to illness, accidents, acts of God, or any other actions not under its control.

 

Provisions:

§   Any equipment changes shall be made at CHOCOLAT’s sole discretion.

§   This agreement of CHOCOLAT ELEGANT FONDUE, INC. to perform for Client shall be excused by detention of personnel, agents, and/or employees by riots, strikes, epidemics, terrorism, acts of God, Force Majeure, death, critical injury, serious illness or any other legitimate condition beyond CHOCOLAT’s control. If such circumstances arise, all reasonable efforts will be made by CHOCOLAT ELEGANT FONDUE, INC. to find replacement services at the agreed upon fees.  Should Chocolat be unable to procure a replacement, Client shall receive a full refund of monies already paid to Chocolat.  Client agrees that in all circumstances, Chocolat liability shall be exclusively limited to an amount equal to the agreed upon fee.  The parties agree that CHOCOLAT ELEGANT FONDUE, INC. shall not be liable for indirect or consequential damages arising from any breach of contract.

§   In the event of non-payment or partial payment, CHOCOLAT ELEGANT FONDUE, INC. retains the right to attempt collection through appropriate courts. Purchaser will be held responsible for all attorney costs, fees, court costs and/or collection costs incurred by CHOCOLAT ELEGANT FONDUE, INC. to collect the amount due. Purchaser shall be charged $35 for each returned check, plus a $10 service charge for each collection notice. Jurisdiction and venue shall remain the exclusive selection choice of CHOCOLAT ELEGANT FONDUE, INC., and client hereby waives any right, claim, or defense that jurisdiction or venue are improper. 

§   Preparation of the service area is the sole responsibility of the Client, even if the Client is not the owner/operator of the serving area. Failure of the serving area to be ready may necessitate a delay or cancellation of duties.  In the event that a delay is experienced, CHOCOLAT ELEGANT FONDUE, INC. shall not be obligated to extend the serving times nor reduce the amount of payment due as shown on Invoice.

§   Client shall be responsible for the safety and security of all Client guests and CHOCOLAT ELEGANT FONDUE, INC. equipment and employees during performance.  CHOCOLAT ELEGANT FONDUE, INC. reserves the right to end the contracted duties due to failure of the Client to provide adequate safety and security.  Any damages caused to, and/or theft of CHOCOLAT ELEGANT FONDUE, INC. equipment caused by any guests at Client's event or function is the responsibility of the Client.

§   Client agrees to assume complete liability for all claims of personal injury, loss or property damage arising from the use(s) and hold CHOCOLAT ELEGANT FONDUE, INC. harmless and with no liability in all such cases, including claims, actions, proceedings, costs, damages, and liabilities, including attorney fees, arising out of, connected with, or resulting from the use of CHOCOLAT ELEGANT FONDUE, INC. or its equipment.

§   Client, and or the person signing this agreement, including Client's representative, is at least 18 years of age and has fully read all provisions of the agreement and can legally enter into the agreement on behalf of the Client.

§   This Agreement constitutes the complete understanding between the parties, unless amended by a written instrument or contract signed by CHOCOLAT ELEGANT FONDUE, INC. and Client. 

 

Liability: This agreement and the contents hereof represents the only warranties, express or implied, between the parties, including any implied warranty or merchantability or fitness for the particular purpose and for any other obligation or liability on the part of CHOCOLAT ELEGANT FONDUE, INC.

§    Client shall compensate CHOCOLAT ELEGANT FONDUE, INC. for any loss it may sustain as a result of client cancellation of all or part of an order without seventy-two (72) hours’ prior notice, up to and including any balance monies due.

    IN WITNESS WHEREOF, this Agreement has been executed and delivered by the Client and the Client acknowledges that upon acceptance by the valid execution hereof by CHOCOLAT ELEGANT FONDUE, INC. this Agreement shall be legally binding whether transmitted by mail, e-mail, or fax.

 

A signed copy of this agreement will be sent to client upon receipt of deposit. Please sign and return to CHOCOLAT ELEGANT FONDUE, INC. for processing. Thank you for choosing CHOCOLAT ELEGANT FONDUE, INC. We look forward to being of service to you.
